The organization of the products is the responsibility of TourManiaK, travel agency, RNAVT 8377, NIF 245575286, and the booking policy is complemented by the program of each product in which the TRAVELLER signs up.
The TRAVELLER acknowledges and accepts the booking policy set out below when booking a product with TourManiaK, travel agency, RNAVT 8377, NIF 245575286.
1 – RESPONSIBILITY
TourManiaK’s liability is guaranteed by the Travel and Tourism Guarantee Fund of Portugal, and by the civil liability insurance of the AGEAS insurance company, under the terms of the legislation in force.
2 – REGISTRATION
Once you have selected the product you want, you must fill in the registration form in full. Our products are always booked in advance, allowing enough time for everyone to book their flights (when necessary), guaranteeing the best price.
3 – BOOKING
Each booking is only confirmed after payment of the deposit or the total amount (non-refundable – exception, see point 7), within a maximum of 24 hours. Otherwise, your booking will be canceled and you will have to register again. If payment is made by bank transfer, you must send proof of the transfer to the TourManiaK email address – info@tourmaniak.com – with personal identification and booking number.
4 – PRODUCT OUT OF STOCK
If the product is out of stock, TourManiaK will notify you before you pay of an alternative, previously defined date. If the new dates coincide with your availability, you can proceed with the booking as mentioned in point 3.
5 – TOTAL PAYMENT
Full payment must be made in accordance with the policy for each product, with the appropriate supporting documents, as mentioned in point 3. TourManiaK will cancel reservations for which payment has not been made within the stipulated period.
6 – CHANGING PRODUCTS OR DATES
Travelers may not change their product or date without first notifying TourManiaK. If possible, the change will be made by TourManiaK, subject to the costs and charges set out in point 9.
7 – MINIMUM NUMBER OF TRAVELLERS
Each product has a minimum number of travelers and if this is not reached, TourManiaK will have to cancel it. If the minimum number is not met, no payment will be made to TourManiaK. Notice of cancellation or rescheduling will be given in writing in accordance with the deadline stipulated in the product. If it is not possible to travel on the new dates, you will be refunded all amounts paid, and TourManiaK will not be held liable for any cancellation.
8 – MINIMUM AGE
The minimum age for TourManiaK trips is stated on each product. For underage bookings, this will be agreed in advance between TourManiaK and the legal guardians, in accordance with the applicable legislation. With the exception of products in which there are different requirements or which are agreed between both parties in writing.

10 – NON-FULFILMENT OF THE EXPECTED PRODUCT
In the event that TourManiaK has to fail to provide any of the product’s services before your departure due to non-attributable events (political instability, conflicts, natural disasters, wars, fires, epidemics, pandemics, health risks, terrorism, closure of airports or ports, or other elements beyond TourManiaK’s control), you have the right to cancel and be reimbursed for the amounts already paid or accept new dates, with possible changes to the final price of the product. You can also change the product and if the price is lower or higher, you will be refunded or you will have to pay the difference.
11 – CHANGES
TourManiaK may change the order of the routes, modify and/or replace accommodation, activities, timetables, transport, guides or leaders with others of the same category and quality. In the event of unforeseen circumstances, as mentioned in point 10, you have the right to cancel or request a refund of the difference in services already paid for.
12 – PRICES
Prices are based on the costs of the services and exchange rates in force on the date of the program, and may be subject to changes resulting from variations in the cost of transportation, fuel, taxes, fees and exchange rate fluctuations. In the event of price increases, you will be immediately informed and invited, within the time limit set by TourManiaK, to accept the increase not exceeding 8% of the total value of the product, as provided for in paragraphs 2 to 6 of article 24 of Decree-Law no. 17/2018. All TourManiaK prices include Value Added Tax at the current rate.
13 – COLLABORATIONS
TourManiaK is an agency that carries out products related to the world of tourism where services are present with collaborations such as land, air and sea transport companies, accommodation units, activities, monuments, etc… subject to the terms, conditions and limits imposed by each of them. Please note that some of these conditions exclude and/or limit liability in the event of death, personal injury, delay and loss of or damage to luggage, and TourManiaK or its collaborators accept no liability for any loss as a result of such actions or as a result of any act or omission by third parties.
14 – INSURANCE
All products have travel & personal cancellation insurance included in the price, valid for the period booked, where you can choose from a number of options. If you wish to extend the dates (before and/or after the booked product), just let TourManiaK know, with the additional costs associated. In the event that you abandon one of the products early, after it has started due to illness or accident, you will need to request a medical certificate to present to the insurance. No reimbursement for abandonment will be made directly by TourManiaK or its employees. In case of need, you are responsible for all expenses, the activation of personal insurance and all contacts between you and the insurance company. All proof required by the insurance company is also your responsibility. The guide, leader, monitor or employee present at the scene of the event must remain on site to ensure the smooth running of the product booked by the other travelers, whether they are TourManiaK travellers, travellers from other agencies or travellers booked directly with the product employee.
15 – START OF PRODUCT, GUIDE & LEADERS
On the platform’s products, it is your responsibility to buy the airline tickets (when they are not included) or other means of transport that will take you to the starting point of the product, together with the guide, leader, monitor or collaborator. This is because you can make the most of each destination and extend your stay on your own, always having travel insurance in place (see point 16). Depending on the distance, you can walk, drive, take public or private transport, and this is not normally included in the total price of the product.
A GUIDE is a person authorized by the Tourist Board of the destination, be it local, regional or national. They live and work in the destination for TourManiaK, for one of its employees or independently. A LOCAL LEADER is a person who knows the destination, lives and works there for TourManiaK or one of its collaborators and conducts the visits. They show the destinations, tell their stories through local eyes and experiences; TRAVEL LEADER is a person who may have already worked or even visited the planned destinations several times, but no longer lives there permanently. They have a personal approach and stories to tell, and can become a travel buddy; TOUR LEADER (not a tour guide) is a person who may not have worked, lived or traveled in the destination(s), and has a general and summary perspective. They are also known as escort guides or agency escorts.
On certain occasions we will have a foreign guide who specializes in a certain monument, city, activity or trek, who will accompany you in order to provide greater security and understanding. At certain times the guide, leader, monitor or collaborator will have to make decisions in the interests of the group and you agree to comply with their authority and decisions, as well as with the laws of the place to which you are traveling. The possession or transportation of illegal or restricted substances is prohibited. If you do not comply or if, in the opinion of the person in charge of the group, your presence is not compatible with the well-being of the other travelers or the smooth running of the group, we reserve the right not to let you continue on the booked product. Any threats to safety, well-being or inappropriate behavior on your part towards the group of travelers, whether verbal or physical, may result in the immediate cancellation of your reservation, cancellation made in writing by the person in charge of the group to TourManiaK. In this case, you will be responsible for the related costs, and will have no claims whatsoever against TourManiaK or any of its employees.
16 – BAGGAGE
For products that include flights as an integral part of the itinerary, it is your responsibility to ensure that your luggage does not exceed the size and weight limits imposed by the airlines. We are not responsible for any costs incurred for excessive baggage. TourManiaK and its employees are not responsible for the luggage and other belongings you carry, regardless of the location or means of transportation used. In the event of loss, damage or destruction, you must immediately complain in writing to the service provider, keeping a copy of the complaint. We always recommend that you are with your luggage during loading and unloading operations, and that you read the general conditions of the travel insurance policy that includes luggage.
17 – ACCOMMODATION
Accommodation is normally provided in rooms for two travelers of the same sex (when bookings are made individually, there may be triple rooms). In some cases, when mentioned in the product description, accommodation may be in triple rooms or with more people, beds in train cabins, camping tents, dormitories or others, sometimes having to share with people of both sexes. For single rooms, check the supplement in the options at the time of booking.
18 – MANDATORY DOCUMENTATION
All documentation referred to as compulsory under the terms of each product is non-refundable once purchased. If the reason for cancellation is under the terms of the insurance policy you have taken out, the insurance company may refund your costs.
19 – PUBLICATION OF IMAGES AND VIDEOS
You agree that the photos and videos taken by you and by the guide, leader, monitor or TourManiaK employee may be used to promote the products and promotional media of the TourManiaK platform.
20 – DATA TRANSMISSION
TourManiaK is a travel agency that produces products with various services related to collaborations such as land, air and sea transport companies, accommodation units, activities, monuments, etc. subject to the terms, conditions and limits imposed by each of them. Please note that some of these conditions exclude and/or limit liability in the event of death, personal injury, delay and loss of or damage to luggage, and TourManiaK accepts no liability for any loss as a result of such actions or as a result of any act or omission by a third party.
21 – COMPLAINTS
Each complaint must be made immediately during the product to the guide, leader, monitor or collaborator so that it can be resolved during the product. If it is not possible to resolve it at the time, you will have up to 15 days after the end of the product to submit your complaint in writing (with the written complaint delivered to our guide, leader, monitor or collaborator during the booked product). If the complaint is not submitted within the stipulated time and with supporting documents, it will not be analyzed and you will not be entitled to any compensation that may arise from it. Any anomalies that may arise are reported by the guide, leader, monitor or partner to TourManiaK in writing during or up to 5 days after the end of the product.
NOTE
This Booking Policy is complemented by each program present in the product you book, sometimes with particular or specific conditions that you send us in writing, and agreed by both parties.
